Andy Andersen took a fresh blast at three major record manufac- turers last week for what he termed discriminatory sales practices in supplying schools and libraries.

Andersen charged RCA Victor, Columbia and Capitol with "mak- ing further efforts to bypass deal- ers by supplying schools and libraries at prices equal to or below those offered to dealers.

He said RCA Victor is supplying items directly to school boards and was charging 60 cents on items for which dealers had to pay 71 cents. Andersen said that according to the ad, the items were not even available to dealers.

The SORD president charged that these offers were coining at a time when "spokesmen for these companies were encouraging deal- ers to sell to schools.

Andersen said the association is preparing a code of fair trade prac- tices for consideration by its mem- bers and other interested groups. Andersen said SORD will submit its proposed code to RIAA and ARMADA for suggestions.

He chising which Andersen said would said he felt the code must repre sent a joint effort between SORD, RIAA and ARMADA if it is to be an effective yardstick for the in- dustry.

SORD has already been in touch with ARMADA and was offered full cooperation, he noted. Repre- sentatives from RIAA would also be contacted, said Andersen. One ot the big things to be sought by SORD in its code is a provision for national dealer fran- be legal if it represented a bi-later al agreement between dealers and manufacturers.

In effect, dealers would have to agree to provide certain services in return for exclusive franchising guarantees. These could include such things as stocking a certain percentage of catalog, providing service on hard-to-f;et items and taking an automatic number of all new re- leases.

Pulse figures released last week showed that two-month-old WYNR with its hard-rock policy has definitely made a mark on the Windy City. Its strongest ratings come in the evening hours when WYNR comes up with an 8-point rating to tie for fifth place m the city.

WLS, with its powerhouse Dick Biondi, leads with a 29 rating, WGN and WCFL tie for second with 12 and WIND is third with In the afternoon slot, WYNR comes up with a 6-point rating to tie for sixth place.

WLS again leads with 22, WIND is second with 14 and WGN third with In the morning hours 6- noon WYNR has a 4-point rating for eight place. Rec- ords, Inc. Steen, a veteran record distrib, sold his dis- tributorship to Dick Codlewski and Frank Kelly, of Eastern, Associated and Allied Distributors of Hart- ford, Conn.

Steen said that the reason he was selling his distributorship was because he felt his rack jobbing firm, now located in Woburn, Mass. He felt that he would have a con- flict of interest if he remained in both ends of the record wholesale business.

The Boston-based Sleen has been active in the distribution busi- ness for many years. He made his first entry into rack jobbing a few years ago when he bought the Modern Records rack jobbing firm of Boston. Since then he has been handling both the rack outfit and his distributorship.

He is a member of the board of directors of NARM National Association of Rack Mer- chandisers. Little more than a year ago, at the time the duo was riding high on BMW best seller lists, Bud and Travis went their separate ways. Subsequently, Bud Dashiel and his then newly forhied group, the Kins- men, recorded for Warner Bros. Travis Edmunson recorded for Re- prise. Neither was able to reach the sales or bookings of the team.

After they reunited, they re- ceived conlraclual pitches from other labels. But Liberty told them that the contract was still in force. An agreement was reached last week. Liberty has rewritten the for- mer pact, bringing the benefits more in line with the offers from other labels.

Columbia has denied all charges. Columbia attorneys filed four motions on appeal to the Commis- sion: one asking for more time to answer the allegations; one asking for more of the particulars in the FTC case, and two additional mo- tions asking for dismissal of certain charges in the complaint.

Delay in holding a hearing could go beyond a month's duration, if the Commission decides to request briefs and hold oral argument on the motions. Even jf the Commis- sion decides to reject the motions, a fifteen-day period of grace is customary before hearings are again scheduled.

Avon Music in the last- named city reported three albums containing bossa nova material among its top five LP's: "Jazz Samba. The Burien record outlet in Seattle named the Getz package among its top album sell- ers, but also said that all bossa nova packages were moving well.

Steen said that the reason he was selling his distributorship was because he felt his rack jobbing firm, now located in Woburn, Mass.

He felt that he would have a con- flict of interest if he remained in both ends of the record wholesale business. The Boston-based Sleen has been active in the distribution busi- ness for many years. He made his first entry into rack jobbing a few years ago when he bought the Modern Records rack jobbing firm of Boston.

Since then he has been handling both the rack outfit and his distributorship. He is a member of the board of directors of NARM National Association of Rack Mer- chandisers. Columbia attorneys filed four motions on appeal to the Commis- sion: one asking for more time to answer the allegations; one asking for more of the particulars in the FTC case, and two additional mo- tions asking for dismissal of certain charges in the complaint.

Delay in holding a hearing could go beyond a month's duration, if the Commission decides to request briefs and hold oral argument on the motions. Even jf the Commis- sion decides to reject the motions, a fifteen-day period of grace is customary before hearings are again scheduled.

More and more major mar-! ket stores are reporting that the al-! bum product mostly jazz is catch- ing on. By far the biggest seller in the current bossa nova deluge is "Jazz Samba" by Stan Getz and Charlie Byrd on Verve.

Every store report- ing any bossa nova sales named that package as the hottest item. This is reflected in the current high position of the LP. on this week's Top LP chart: No. In all. Washington, Cincinnati and Philadelphia. A number of these markets reported that other albums besides the "Jazz Samba" package were beginning to move.

The Ammons set has been mentioned as the hot- test new LP in a number of stores in Chicago, Washington and Cin- cinnati. Avon Music in the last- named city reported three albums containing bossa nova material among its top five LP's: "Jazz Samba.

The Burien record outlet in Seattle named the Getz package among its top album sell- ers, but also said that all bossa nova packages were moving well. Ill Ammons, who has always been a strong and steady seller, the bossa nova supporters in the trade believe they may have a big album that will break the new rhythm in jazz-oriented, r.

Kandy Tapes Offers Deal CHICAGO— Kandy Tapes and Records is offering a "seven for price of six" deal on its complete catalog of LP's and singles.

The catalog features Don Johnson's "Organ With a Beat" monaural and stereo disks. Suit was initiated originally by Hurok Concerts-Carnegie Hall to restrain the defendants from sell- ing, advertising, manufacturing or utilizing in any way the Richter records recorded at the famed hall.

Columbia has already issued some of the Richter Carnegie Hall disks and is going ahead with its plans to issue others from the Rus- sian pianist's concerts at Carnegie last October. The records were ob- tained from Artia Recording Cor- poration - MJP Enterprises, who managed to obtain the tapes from the "unknown" persons who re- corded the pianist at these concerts.

There was a hassle over the Richter Carnegie tapes when Co- lumbia started to negotiate for them last winter. World-wide distribution of over 25, copies— to Blllboard't more than 20, ubserlbers— plui 5, extra copies fo meet ' the demand for this vital reference hiue.

Ministry of Culture had worked out a deal with RCA Victor to have Richter exclusively and both were rather upset when they learned Columbia was negotiating for the tapes. The Carnegie Hall Corpora- tion claimed the recordings were made without its knowledge, and that no one could use the name Carnegie Hall on an album without its permission.

However, the disagreement was ironed out not long ago through conferences between representa- tives of the Hurok office, Carnegie Hall management, the Artia-MJP people and a clutch of Russian government officials. Reports are that everything will be officially signed within a fort- night, and that Columbia will be able to issue its next Richter con- cert packages without a hitch.

Top Pops Get Shuffle in S. SAN FRANCISCO— Cut-backs in the best-seUIng records playlist of two major radio stations here — KYA and K. EWB — have caused some concern among San Francisco distributor and dealers.

The two stations, which have high ratings for their pop formats, have launched policies of mixing oldies-but-goodics and other standards in with their off-the-charts fare.

KEWB, in fact, has a "Flashback" running feature in which every other record in deejay stanzas is an oldie. Said one San Francisco distributor: "It's an interesting technique, but it's not stirring any action for the record industry in singles.

A lot of what's being played as 'oldies' exists now only in private collections. Several hot new singles were reportedly breakmg in the Bay area, some of which are doing better locally than they are on the full national scene.

These included a side by the Majors on Imperial called "She's a Troublemaker. Also active: "Comin" Home Baby," with Mel Torme on Atlan- tic; "Don't Make Me Over," with Dionne Warwick on Sceptre; Timi Vuro's "Love of a Boy" on Liberty, artd Ketty Lester's "Your Land Is My Land" on Era.

OH, , LET'S MAKE NICE MUSIC TOGETHER NEW YORK — Dccca Records introduces two new artists m its "Music From Mathematics" LP this week when the IBM computer and the Digital to Sound Transducer make their disk debuts.

The electronic duo are the stars of the new Decca album and the results of their rapid and unerring calcula- tions make the music heard on the disk. The process of composing music for the computor is de- scribed by the label as "outlining musical sounds by ascribing to them mathematical sequences of numbers.

The numerical descriptions are the equivalent of particular sounds. These, in turn, are transferred into sounds which are amplified and recorded on to the usual tape recording console. Decca notes that the composer is still the controlling factor and, in so many words, without the man, the machines can't go.

So far this kind of music has been produced instrumentally, but It IS also known that the Bell Laboratories have produced a smgmg voice through electronic manipulation. It shouldn't be too long before card-feeding composers create tomorrow's Bingmg idol.

It is his feeling that each coun- try must be considered individually when plans are made for the launching of an artist. The tempera- ment, past performance and mood of the population in each market must be the governing quality.

Preston said that no new trad jazz Bilk material would be avail- able in the United States for some time. He believes that Bilk is still building as an artist here and that the American people have ac- cepted him in a string showcase for the time being.

Basin Street East, last week 1 , with a whole new act and a new band— with strings — led by her new arranger-conductor, Benny Carter. In honor of the occasion Basin Street East chief Ralph Watkins had the old bandstand torn down and a new one built, the belter to display the thrush and the ork.

And once again Peggy scores a personal triumph as she has every time she has appeared at the East Side boite. New act, old act, Peggy is as wonderful as ever. She can move from a mood of sorrow to a mood of swinging happiness within one song and carry the audience along with her from mood to mood.

She knows how to use her hands, ber body and her eyes, as well as ber voice, and there are few singers about today who can compare with ber. And she does it all while showing off that beguiling smile that makes her a joy to watch, Peggy ran through close to a score of songs without re- peating any of the oldies that have long Identified her.

And after she had the audience in the palm of her hand, she came back to sing some of her oldies, including "You Gotta Have Heart," "Get Out of Here and Get Me Some Money, Too" and "I'm Gonna Go Fishin'. But it wouldn't matter if Peggy didn't have the strings. She sets her own mood, and her month-long engagement at Watkin's club should again see her fans standing in line nightly.

A long list of topflight disk and music names took part in the celebration singing a myriad of Rodgers hits written over the past four decades. The show was done live before cameras and audiencs at Carnegie Hall.

The star-studded cast took part in a potent presentation of material drawn from the wealth of material written by the composer as collaborator with Larry Hart and Oscar Hammer- stein U. In addition, Sullivan talked with Alan Jay Lemer, Rodgers' latest partner in the forthcoming show "Pick a Daisy.

The chorus was under the staff direction of Robert De Cormier. Sullivan also read congratulatory telegrams from statesmen and celebrities. Among the top record acts appearing were Peggy -tM, Peter Nero, Steve Lawrence, Roberta Peters, Cesari Siepi, Diahann Carroll, Gordon MacRae and Nancy Desault.

Tunes all were drawn from the Rodgers shows, and Miss Carroll sang two tunes from "No Strings," Rodgers' current show, for which he wrote both words and music for the first time. Only criticism viewers found in this ambitious and tuneful salute was spotty sound reproduction from the Carnegie stage.

JACK MAHER CONCERT Otto Klemperer on a Bad Night Otto Klemperer made his first appearance as guest con- ductor of the Philadelphia Orchestra at Philharmonic Hall in New York last week 6. A fortnight previously he had con- ducted the Philadelphians in a widely acclaimed concert at Carnegie Hall as part of his first appearance as a conductor in the U.

in more than 10 years. In spite of the eager anticipation with which Philadelphia Orchestra subscribers had looked forward to Klemperer's first Philharmonic showcase, the concert was a disappointment- Much of this was due to the slow, languid tempos at which Klemperer batoned Beethoven's "Egmont Overture" atid Brahms' Third Symphony.

The latter appeared to fall apart after a forthright opening. Most surprising of all, the Philadelphians sounded unsure of themselves, and there were occasions when sections were off on their attacks or their endings.

Most impressive job on the part of Klemperer and the Or- chestra was the performance of Schumann's Fourth Symphony. The spirited work was conducted vigorously and the Philadel- phians responded with spirit and the warm sound that has usually marked the orchestra. It is hoped that Klemperer's next appearance at the new hall with the Philadelphians will live up to the high standard most of us expect from him.

Composed of some fine night club-type material, the album has pace and class. All of the tune titles begin with the first person singular, but there's nothing self-conscious about the sing- ing.

Some of the fine tracks are "I Concentrate on You," "I'm Confessin'," "1 Understand" and "I Surrender Dear. MGM 1E4 M ; 1SE4 S — Here's the music from the sound track of the current movie "Mutiny on the Bounty. It's a stirring set which will be a prime item to those who want to relive the film again and again.

FIRE AND JEALOUSY Andre Kostefamclz and his Ork. Cohimbia CL M ; CS S — Kostelanetz has a tremendous following among those who like the light classic and string ap- proach and this set should be another find for them. It features the lush but vibrant string style of arranging on some great Latin American standards.

TWO FOR THE SEE SAW Sound Track. United Artists UAS S ; UAL M — This is Andre Previn's score from the new film which has more co-production firms than it has principal players. It's a "modern" score, jazz-flavored in the Previn maimer. The movie's theme, "Second Chance," appears twice in the album, once with a vocal by Jackie Cain.

Previn fans will like it, and several tracks from the album are worthy of deejay spins. SOMETIMES FM HAPPY. SOMETIMES PM BLUE Vincent Edwards. Decca DL M ; DL S — Here's another prime item from the Dr. Ben Casey TV star. Edwards sings a raft of standards on the LP backed by strings and ork.

The tunes are both in an easy, bouncing style and in the touching ballad groove. The lad sings in the style that has taken him to the hearts of many listeners. MOVIE AND TV THEMES Elmer Bernstein.

Cliorco A-H Mlj AS S — timer Bernsleiu conducts a crack, hand-picked oik from the ranks of HoUyw'ood's best musicians for this LP of his movie and TV theme compositions. The band has spirit and bite and some of the performances are electrifying. Many familiar melodies, like "Man With the Golden Arm," "Sweet Smell of Success" and "Walk on the Wild Side" are included, as well as one of Bernstein's latest, "Saints and Sinners.

rVE GOT A WOMAN Jimmy McGrlff, Sue LP — There's going to be an ~ awful lot of action for this album in jazz and r. circles as well as in the pop world. It's a swinger, with organist McGriff stepping right down on his hit "I've Got a Woman," and some other potent material. Besides the hit, "All About My Girl," "M.

Blues," "That's the Way I Feel," "Flying Home" and "Sermon" are topflight tracks packed with fire and excitement. The album has swing and fine stereo programming with strong solo work from leader Doc Severinson and the late Eddie Costa.

The album moves right along with most of the tunes in a middle tempo, and some of the fine tracks are "While We're Young," "Slow Boat to China," "Sky- lark," "The Poor Soul" and "Close Your Eyes.

Kenny Burrell plays great guitar and Ron Carter is bassist along with Rudy Collini on drums. SHIRLEY SCOTT PLAYS HORACE SILVER Prestige PR M — Here is a bright, swinging album that should rack up solid sales for Miss Scott.

The organist comes through with strong performances of some of Horace Silver's best known compositions, including "Senor Blues," "Doddlin"," "The tock organ work should help this one move, and it could grab pop as well as jazz sales.

The top side brings hack memories of her smash hit "You'll Lose a Good Thing" as the lass confidentially and sincerely explains why her boy friend will want her in the future.

The flip, a catchy medium tempo rocker, shows off her powerful vocal style. Jamie BRIAN HVLAND I MAY NOT LIVE TO SEE TOMORROW Pogo, ASCAP — IT AINT THAT WAY AT ALL Pogo, ASCAP — On the top side, Hyland gives a weeper message a strong go in a neat, medium-rhythm tune, backed by a strong arrangement and a Nashville-style chorus.

On the flip. Hyland chants a strong teen ballad in a slow and thoughtful manner, with a humming chorus ; behind the vocal, supported by triplets. LyTic has a good bit of philosophy and Benton sells it all the way. Flip side has a solid sound in a smart, blues-styled tune. Both sides could break big.

Mercury JIMMY CLANTON DREAMS OF A FOOL Blacksmith, BMI — DARKEST STREET IN TOWN Aldon, BMI — A fine weeper "Dream" tune with a good feel on the top side, spotlighting some strong vocal work by Clanton against strings and vocal chorus.
